This Privacy Policy describes how we collect, use, disclose, retain, and protect your personal information through our website, mobile and web applications, including the MigiHub platform (the “Platform”).

1. Scope of this Privacy Policy

This Privacy Policy (the “Policy”) describes how InnuCloud Experts Inc. (“InnuCloud”, “we”, “us”) collects, uses, stores, shares, and protects your personal information when you access and use our MigiHub application (the “Application”), our website, or any other digital platform or service we provide (collectively referred to as the “Platform”).

The MigiHub Platform is designed to support the scheduling, communication, and operational management of interpreters and organizations. This Policy outlines our commitment to managing your personal data responsibly and in accordance with globally recognized privacy standards.

We comply with all applicable data protection and privacy laws, including but not limited to:

  • Loi 25 and the Act Respecting the Protection of Personal Information in the Private Sector (Québec, Canada),

  • The Personal Information Protection and Electronic Documents Act (PIPEDA) (Canada),

  • General Data Protection Regulation (GDPR) (European Union and European Economic Area),

  • California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA) (United States, California),

  • Children’s Online Privacy Protection Act (COPPA) (where applicable),

  • And any other regional, national, or international privacy laws that govern the protection of personal data.

Regardless of your location, we strive to ensure that your information is handled with transparency, accountability, and the highest standards of data protection.

For the purposes of this Policy, “Personal Information” (also referred to as “Personal Data” under certain laws such as the GDPR) means any information that relates to an identifiable individual, either directly or indirectly.

This includes, but is not limited to:

  • Professional or employment-related data (e.g., availability, certifications, résumés);

  • Government-issued identifiers (e.g., Healthcare Insurance Number, when legally required);

  • Device and usage data (e.g., IP address, geolocation, browser type, and access logs);

  • Audio, video, and biometric information (if collected, with consent);

  • Any other data that can reasonably be used, alone or in combination with other information, to identify a natural person.

This definition is consistent with the requirements of Loi 25, GDPR, CCPA/CPRA, and other applicable privacy regulations in the jurisdictions where MigiHub operates or provides services.

3. Personal Information Management Program

To ensure the protection of your Personal Information, InnuCloud Experts Inc. has implemented a comprehensive Personal Information Management Program (PIMP) that governs the way we collect, use, store, disclose, and dispose of your data across all components of the MigiHub Platform.

This program includes formalized internal policies, operational procedures, and security controls designed to:

  • Ensure compliance with applicable privacy laws, including Loi 25, PIPEDA, GDPR, and CCPA/CPRA;

  • Regulate the lifecycle of personal data: from collection and consent to retention and secure destruction;

  • Guide the handling of data access requests, complaints, or privacy inquiries;

  • Govern third-party data sharing, with strict vendor management protocols;

  • Mandate Privacy Impact Assessments (PIAs) when required by law or internal risk frameworks;

  • Ensure timely detection, escalation, and mitigation of privacy incidents or data breaches;

  • Establish data governance and training practices for employees and contractors with access to personal information.

All components of this program have been reviewed and approved by our Data Protection Officer (DPO) and are regularly updated to reflect evolving legal and operational requirements.

The collection and processing of your Personal Information through our website, the MigiHub application, and any associated platforms are carried out in full compliance with the principles and safeguards defined in this program.

4. Personal Information Protection Officer

InnuCloud Experts Inc. has appointed a Data Protection Officer (DPO) to oversee the management and ongoing compliance of its privacy and data governance program, including all activities related to the MigiHub Platform.

The DPO is responsible for:

  • Approving and enforcing our internal privacy policies and procedures;

  • Ensuring the effectiveness of our privacy program through regular audits and performance reviews;

  • Advising on compliance with applicable privacy laws (e.g., Loi 25, GDPR, PIPEDA, CCPA/CPRA);

  • Serving as the main point of contact for privacy-related inquiries, access or correction requests, data subject rights, and complaints;

  • Leading responses to privacy incidents and coordinating breach notifications, when required;

  • Acting as liaison with regulators and supervisory authorities, where applicable.

5. Fundamentals for Processing Personal Information

In order for you to fully use the MigiHub Platform, including its scheduling, communication, and interpreter management features, InnuCloud Experts Inc. must collect and process certain Personal Information.

We are committed to processing only the data that is strictly necessary to fulfill our legitimate purposes, which are clearly communicated through this Policy or during specific interactions (e.g., account registration, job matching, or employer engagement). All processing activities are conducted in accordance with privacy laws applicable in your jurisdiction, including but not limited to Loi 25, PIPEDA, GDPR, and CCPA/CPRA.

6. Legal Bases for Collection and Use

The primary legal grounds on which we rely for processing your personal information are:

1.    Your Consent

We collect most of your Personal Information with your freely given, informed, and explicit consent, especially when the data is considered sensitive (such as employment or geolocation data).

Examples include:

  • Collecting your availability and qualifications to match you with interpreting assignments;

  • Requesting your express permission to access geolocation data when you check in or out of an assignment;

  • Sending an activation invitation on behalf of your employer or client organization and obtaining your consent to collect any work-related information.

We always favor direct collection from you, and your consent can be withdrawn at any time, subject to legal or contractual limitations.

2.    Performance of a Contract

Some processing is necessary to fulfill our contractual obligations to you or your employer/client. For instance:

  • Enabling access to the Platform;

  • Managing work schedules, time-tracking, and assignments;

  • Facilitating payments and account management services.

3.    Legal Compliance

We may collect or disclose Personal Information when required to comply with laws, court orders, or legal obligations, including regulatory reporting or investigation processes.

4.    Legitimate Interests

In certain cases, we may process your information based on our legitimate interests, provided these do not override your rights and freedoms. Examples include:

  • Improving the functionality and performance of the MigiHub Platform;

  • Preventing fraud or misuse;

  • Conducting data analytics to enhance user experience.

We will always strive to keep you informed about the purpose, scope, and impact of any data processing activity and obtain appropriate consent wherever required by law.

5.    Other Permitted Legal Usage (e.g., Contract Performance and Legal Obligations)

In addition to collecting your Personal Information based on consent, InnuCloud Experts Inc. may also collect and process certain data without your express consent when allowed under applicable privacy laws.

This includes, but is not limited to, the following circumstances:

  • To perform a contract: When you are a party to a contract—directly or indirectly through an employer or client organization—we may process your data as necessary to fulfill our contractual obligations. For example:

    • Creating and managing your MigiHub account;

    • Scheduling interpreting assignments;

    • Facilitating communication between interpreters and organizations;

    • Recording work hours and locations (when applicable) to support time-tracking features;

    • Providing customer support and technical assistance.

  • To comply with legal obligations: We may process or disclose your Personal Information if required to:

    • Respond to lawful requests from government authorities or regulators;

    • Comply with labor, tax, financial, or civil law requirements;

    • Cooperate with investigations, audits, or enforcement procedures;

    • Fulfill obligations under employment or workplace legislation, where applicable.

These processing activities are limited to what is strictly necessary, are governed by our internal data governance program, and are always carried out in a way that respects your fundamental rights and freedoms.

7. Personal Information Collected

The types of Personal Information we collect depend on how you interact with the MigiHub Platform—whether as an interpreter, agency representative, client organization, or administrative user.

We collect the following categories of Personal Information:

  • Social media identifiers (if you log in through third-party platforms)

  • Preferred language and role within the Platform

7.    Employment and Professional Data

  • Résumés (CVs), qualifications, and professional certifications

  • Years of experience and interpreter specializations

  • Availability schedules and location preferences

  • Additional employment-related information submitted through onboarding forms or by your employer

8.    Application and Platform Usage Data

  • Login and logout timestamps

  • Pages visited, features used, and interaction patterns

  • IP address, device ID, and browser type

  • Session duration, error logs, and usage analytics

  • Geolocation data (collected only with explicit consent at specific moments, such as when clocking in/out)

9.    Mobile Device Data

  • Device type and unique device identifiers

  • Mobile operating system version (e.g., iOS or Android)

  • IP address and browser/app version

  • Geolocation data (e.g., GPS or beacon-based location, only collected temporarily and with consent)

  • Mobile advertising identifiers (e.g., Apple’s IDFA or Google’s AAID), where applicable

10.           Human Resources and Employment Status Information

(if collected via your employer or directly for job-matching purposes)

  • Employee ID or interpreter reference number

  • Hourly rates, gender identity (where legally permitted), and emergency contact details

  • Work authorization documents, if applicable

11.           Shift and Scheduling Information

  • Dates, times, and locations of scheduled interpreting assignments

  • Clock-in and clock-out records (used in accordance with employer settings)

  • Photos captured during assignment check-ins (when enabled by your organization)

  • Roles or positions held during assignments

12.           Feedback and Communication

  • Responses to surveys, ratings, and feedback forms

  • Messages submitted to customer support or through contact forms

  • Feedback provided by or about you through the platform (e.g., interpreter evaluations)

8. Personal Information of Minors

Protecting the privacy of children is a priority for InnuCloud Experts Inc.. The MigiHub Platform is not intended for use by individuals under the age of 14. Our services are designed for professional and organizational use by interpreters and the entities that manage them.

However, in certain cases, a minor may be engaged by a client organization (e.g., as an intern or junior interpreter), which could result in the collection of personal data from or about that minor.

In such cases:

  • We will not collect any Personal Information from a minor under 14 years of age without the explicit consent of a parent, legal guardian, or an authorized individual holding parental authority.

  • For minors aged 14 and over, we will obtain their direct, informed consent when permitted by applicable law.

  • Employers or organizations using MigiHub are contractually required to ensure compliance with youth employment and privacy laws when registering any minor interpreter or staff member on the platform.

If a parent or guardian becomes aware that their child has submitted Personal Information through MigiHub without proper consent, they may:

  • Request access to the information collected about their child;

  • Request the deletion of the information from our records.

To exercise these rights, parents or guardians should contact our Data Protection Officer using the contact details provided in the Privacy Officer section. We will respond to such requests promptly and in accordance with applicable privacy legislation.

9. Purposes of Collecting Personal Information

We only collect Personal Information that is necessary, relevant, and proportionate to support your interaction with the MigiHub Platform, and to deliver our services in compliance with applicable laws and industry best practices.

Your Personal Information may be used for the following purposes:

  • To provide access and functionality across the MigiHub website, mobile application, and digital services;

  • To create and manage your user account, schedule interpreting assignments, and facilitate interactions between interpreters and organizations;

  • To respond to your inquiries, support tickets, feedback, complaints, or requests for assistance;

  • To develop, maintain, and improve our services, platform functionality, and user experience;

  • To conduct internal analytics, such as usage trends, performance diagnostics, user activity, and service enhancement opportunities;

  • To send administrative communications, including changes to our terms, service availability, and feature updates;

  • To send marketing communications, such as newsletters, service-related promotions, feature announcements, or event invitations—always in accordance with your communication preferences;

  • To deliver push notifications, SMS alerts, or mobile updates with your consent;

  • To monitor for fraud, abuse, unauthorized access, or security risks and ensure the integrity of the platform;

  • To comply with legal and regulatory obligations, including but not limited to:

    • Responding to lawful government or regulatory requests;

    • Protecting InnuCloud’s legal rights and operations;

    • Exercising or defending legal claims;

  • To monitor and optimize how the MigiHub Application is used, including identifying bugs, improving performance, and detecting misuse;

  • To improve user experience, such as personalizing dashboard views or remembering session preferences;

  • To support your employer or organization in delivering the services they have subscribed to, including time tracking, scheduling, and contract management;

  • To submit applications on your behalf, when you have explicitly indicated your interest in an assignment or opportunity via the Platform;

  • To suggest jobs, shifts, or contracts based on your profile, preferences, and availability;

  • To fulfill any other purpose for which you have provided your informed consent.

If we intend to use your Personal Information for any new purpose not listed above, and where required by law, we will seek your explicit consent or provide you with appropriate notice before proceeding.

10.      Disclosure of Personal Information

At InnuCloud Experts Inc., we do not sell your Personal Information. However, to operate the MigiHub Platform effectively and deliver our services, we may disclose certain Personal Information to authorized third parties under specific conditions, and always with appropriate safeguards in place.

Your Personal Information may be shared with the following parties:

13.           InnuCloud Team Members

Authorized employees, contractors, and representatives of InnuCloud may access your data only to the extent necessary to:

  • Deliver technical support;

  • Process user requests and inquiries;

  • Monitor system operations and ensure security;

  • Carry out administrative and contractual duties.

All staff are trained in privacy compliance and subject to strict confidentiality agreements.

14.           Service Providers and Technology Partners

We may engage third-party service providers to perform functions on our behalf, including:

  • Cloud hosting and infrastructure services;

  • Payment processing (if applicable);

  • Data analytics and performance monitoring;

  • Customer support platforms;

  • Email and communication systems;

  • Identity verification and authentication tools.

All such providers are contractually bound to protect your Personal Information, and where required, Privacy Impact Assessments (PIAs) are conducted before onboarding third-party processors. Some of these providers may operate in jurisdictions outside your own (see “Third Parties Located Abroad” section).

15.           Client Organizations (Employers or Agencies)

If your account is linked to an employer, agency, or interpreting organization that uses MigiHub:

  • Your professional profile, work schedule, and availability may be visible to authorized users within that organization;

  • Clock-in/out records, assignment history, and submitted documentation may be accessed by your employer to support workforce and HR functions;

  • Your employer is contractually obligated to use this data only for internal operational purposes and not for marketing or reselling.

16.           Regulatory and Legal Authorities

We may disclose Personal Information when required by applicable law, regulation, legal process, or governmental request, including but not limited to:

  • Court orders or subpoenas;

  • Audits or investigations by data protection authorities;

  • Emergency requests involving safety or public interest.

17.           In Case of Business Transfers

If InnuCloud undergoes a merger, acquisition, restructuring, or sale of part or all of its business, your Personal Information may be shared with involved parties during due diligence or as part of the finalized transaction. In such cases, we ensure that:

  • Data is shared only as necessary;

  • Appropriate confidentiality and data protection agreements are in place;

  • You are notified if legally required.

11.      Third Parties Located Abroad

Some of our service providers and technology partners may be located outside your province, state, or country of residence, including jurisdictions where privacy laws may differ from those in your home region.

When Personal Information is transferred internationally—for example, to cloud service providers or customer support partners located in the United States or the European Union—InnuCloud Experts Inc. ensures that such transfers are made in compliance with applicable laws, including:

  • Conducting Privacy Impact Assessments (PIAs) where required by Loi 25 or GDPR;

  • Implementing contractual safeguards, such as Standard Contractual Clauses (SCCs) or Data Processing Agreements (DPAs);

  • Verifying that foreign service providers maintain equivalent or adequate levels of protection for Personal Information;

  • Ensuring that all data transferred abroad remains subject to the same rights and protections as if it were processed in Canada.

By using the MigiHub Platform, you acknowledge and agree that your Personal Information may be accessed or stored in countries outside your own, and that it may be subject to disclosure under the laws of those jurisdictions.

12.      Time Clocks

The MigiHub Platform may include digital time-tracking functionalities (referred to as "Time Clocks") that enable interpreters and other personnel to clock in and out of scheduled assignments. These tools are provided to support accurate scheduling, compliance, and internal reporting for organizations that use MigiHub for workforce coordination.

When Time Clocks are enabled, the following data may be collected at the time of check-in or check-out:

  • Timestamp of entry or exit

  • Geolocation data, such as GPS or beacon-based location (only with your explicit, time-limited consent)

  • Photographic confirmation, if required by the employer (also subject to explicit consent)

18.           Important Privacy Commitments:

  • MigiHub will never collect geolocation or biometric data without a clear consent prompt, and only for the punctual moment needed (e.g., at check-in/check-out).

  • When required by a client organization, you will always be informed in advance if your photo or location will be collected.

  • In such cases, your organization (employer or client) is responsible for obtaining your prior, written, informed, and specific consent, and for offering a reasonable alternative method of clocking in/out if you object to photo or geolocation tracking.

  • MigiHub will not retain this data longer than necessary. Unless otherwise instructed by the client organization, such data will be retained for a maximum of one (1) year.

  • MigiHub processes this data strictly on behalf of the client organization and only for the intended operational purposes.

If you have questions about how your organization uses the Time Clock feature, or if you wish to object to its use, we recommend contacting your employer or designated platform administrator.

13.      Retention and Destruction of Personal Information

InnuCloud Experts Inc. retains your Personal Information only for as long as necessary to:

  • Fulfill the purposes described in this Policy;

  • Meet legal, regulatory, and contractual obligations;

  • Protect our legitimate business interests;

  • Respond to inquiries, audits, or potential disputes.

19.           Retention Periods

Retention periods may vary depending on the nature of the data and the relationship with the user:

  • Active accounts: Personal Information is retained for the duration of the user’s account activity.

  • Inactive or terminated accounts: Information is archived or anonymized after a reasonable period of inactivity (typically up to 7 years) unless a longer period is required by law or justified for legal defense or contractual audits.

  • Time Clock data: When collected, photos and geolocation records associated with clock-in/out events are retained for a maximum of one (1) year, unless otherwise specified by the organization using MigiHub.

  • Client organizational data: Subject to the data retention policies agreed upon in the service agreement with the client.

20.           Data Deletion and Account Deactivation

You may request the deletion of your Personal Information at any time by:

  • Using the "Deactivate My Account" option (if available in the application); or

  • Contacting our Data Protection Officer directly at privacy@migihub.com.

Upon receiving your request:

  • We will notify your associated employer or organization (if applicable), allowing them up to 10 business days to export or archive data needed for internal HR or compliance purposes.

  • We will complete the deletion process within 30 calendar days, unless legal obligations require us to retain certain information longer.

  • You will receive a confirmation of deletion upon completion.

Note: Account deactivation or data deletion via MigiHub does not constitute resignation or any modification to your employment relationship. You must contact your employer directly to manage your employment status.

14.      Security

At InnuCloud Experts Inc., the security of your Personal Information is a core priority. We apply industry-leading security practices to ensure that your data is protected against unauthorized access, misuse, loss, alteration, or disclosure, whether during storage or transmission.

21.           Key Security Measures

To safeguard the Personal Information processed through the MigiHub Platform, we have implemented a comprehensive security framework that includes:

  • Data Encryption: All Personal Information is encrypted in transit (using HTTPS/TLS protocols) and at rest within secure cloud infrastructure.

  • Role-Based Access Controls (RBAC): Only authorized personnel have access to data, with strict permissions based on roles and responsibilities.

  • Multi-Factor Authentication (MFA): Used for internal administrative access and available to users for enhanced platform security.

  • Regular Vulnerability Assessments: We conduct internal and third-party audits to identify and resolve potential vulnerabilities.

  • Security Monitoring and Intrusion Detection: Our infrastructure is monitored in real time for suspicious or unauthorized activity.

  • Privacy-by-Design Practices: Security and privacy are integrated at every stage of MigiHub’s product development lifecycle.

22.           Staff Awareness and Training

All InnuCloud staff members and contractors with access to Personal Information:

  • Are required to sign confidentiality agreements;

  • Receive regular training on data protection, privacy compliance, and secure handling practices;

  • Are subject to disciplinary procedures in the event of policy violations.

23.           Incident Response and Breach Notification

Despite all measures, no system is entirely immune to threats. In the unlikely event of a security incident or personal data breach:

  • Our team will activate our incident response protocol;

  • Affected users and relevant regulatory authorities will be notified within the timeframes required by law;

  • We will work transparently and diligently to mitigate the impact and prevent recurrence.

15.      Your Rights Relating to Your Personal Information

Depending on your location and the privacy laws applicable to you, you may have a number of rights regarding the Personal Information we collect and process through the MigiHub Platform.

  • Rectify inaccurate or incomplete information: Request corrections to your data if it is incorrect, outdated, ambiguous, or incomplete.

  • Withdraw your consent: Revoke your consent at any time for any processing activity that relied on it (without affecting the lawfulness of prior processing).

  • Request data deletion: Ask us to delete your Personal Information when it is no longer necessary, or when consent is withdrawn and no other legal basis applies.

  • Restrict or object to processing: Request limitations on processing in certain cases (e.g., while we verify accuracy, during a legal dispute, or for direct marketing objections).

  • Data portability: Receive your Personal Information in a structured, commonly used, and machine-readable format, and request its transmission to another organization.

26.           Marketing Communications

  • You can unsubscribe by clicking the “Unsubscribe” link in the footer of any marketing email.

  • You may also email us directly at privacy@migihub.com with your opt-out request.

Please note: Even if you opt out of marketing messages, you may still receive transactional or service-related communications (e.g., shift notifications, platform alerts, or administrative updates), which are necessary for using the MigiHub Platform.

27.           Location Data

When applicable (e.g., during time clock check-ins), you may be asked to grant one-time access to your device's location.

  • This is always optional and triggered by a clear consent prompt.

  • You may disable location tracking at any time via your device settings (e.g., iOS or Android privacy settings).

  • If you disable location access, some features may be limited (e.g., location-based time tracking).

28.           Cookies and Tracking Technologies

The MigiHub website uses cookies and similar technologies to enhance your user experience.

  • Essential Cookies: These are necessary for the operation of the Platform and cannot be disabled.

  • Non-Essential Cookies: Used for analytics, personalization, or advertising. These will only be activated with your consent.

29.           Mobile Advertising Identifiers
